Topic > Title VII of the Civil Rights Act of 1974 - Gender and...

Despite equal opportunity legislation, sexism is still evident in the workplace. Women have made great progress in the workforce and have become an integral part of the job market. They have greater access to higher education and, as a result, greater access to traditionally male-dominated professions, such as law. Although statistics show that women are equal to men in terms of the number of people in the legal profession, it is however clear that they have not yet achieved parity in all other areas of work. Discrimination in the form of gender, sex, and sexual harassment continues to be a problem in today's society. Historically, women have been discriminated against in the United States based solely on their gender. Gender or sexual discrimination can be described as the unfair treatment of a person in the workplace because of their sex. It is illegal to discriminate on the basis of sex and can result in adverse employment effects, including pay, position and title, advancement and training opportunities, or whether or not an individual is hired or fired from a job. Sexual harassment by definition is based on conduct of a sexual nature. An article on ENotes.com describes sexual harassment as: “Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute (are) sexual harassment when they: (1) submit to (accept) . . . or an individual's rejection of such conduct is used as the basis for employment decisions affecting such individual, or (2) such conduct has the purpose or effect of unreasonably interfering with an individual's job performance or creating an intimidating, hostile (threatening), or offensive work environment" (ENots.com...... half of paper ......on Sexual Harassment: The Supreme Court Drama.
